The easyBitcoin.app BTC Giveaway Program Terms and Conditions (these “Terms”) set forth the terms and conditions for participation in the giveaways offered to easyBitcoin.app account holders who meet the conditions outlined below (each, a “Giveaway” or collectively referred to as, the “Giveaway Program”) sponsored by the easyBitcoin.app (as powered by Uphold HQ, Inc., “Uphold,” licensed by and in partnership with easyGroup Ltd., “EG,”). Only easyBitcoin.app account holders in good standing (each, a “Participant”), as further outlined below, are eligible to participate in the Giveaway Program.

Eligibility

The Giveaway Program is open only to easyBitcoin.app account holders in good standing who are legal residents of the United States who are at least 18 years of age at the time of entry. Employees of Uphold or EG, including each of its subsidiaries and affiliated companies and their respective directors, officers, employees, agents, representatives, advertising or promotional agencies, members of their immediate families, and persons with whom any of the foregoing are domiciled are not eligible to participate in the Giveaway Program.

To enter each Giveaway, Participant must, during the applicable giveaway period:

  • follow us on X (formerly Twitter);
  • share the official Giveaway post on 𝕏; 
  • download the easyBitcoin.app;
  • successfully create an easyBitcoin.app account and complete all verification checks; 
  • screenshot your app home screen as instructed in the official Giveaway post and share on 𝕏. 

All steps must be completed (in no particular order)  during the applicable giveaway period to qualify for the Giveaway.

Giveaway Periods

There are several separate promotional giveaway periods to win BTC (each earning a “Giveaway Prize”) governed by these Terms.

Giveaway Prizes

The total number of giveaway prizes (each, a “Giveaway Prize”) available for each Giveaway will be specified in the applicable social media or blog post published by easyBitcoin.app (each, a “Giveaway Post”). If the Giveaway prize is in BTC, the amount of BTC awarded for each Giveaway will be calculated based on the exchange rate published by us on the day the random draw takes place. Each Giveaway Prize  is non-transferrable and non-assignable. No substitutions of the Giveaway Prize are permitted. Each Giveaway Prize consists solely of the specific amounts or items expressly described in the specific Giveaway Post, and no other costs, expenses, or benefits are included. Any and all federal, state, and/or local taxes, fees, and surcharges on each Giveaway Prize are the sole responsibility of each winner. easyBitcoin.app reserves the right to withhold or revoke any Giveaway Prize in the event of any violation of applicable law or our terms and conditions.

Winner Selection and Notification

Winners for each Giveaway will be selected using a random third party selection tool from all eligible entries received and tracked during the applicable giveaway period. Winners will be notified via DM on 𝕏. To claim a Giveaway Prize, the winner must respond to the DM with the email address used to register for the easyBitcoin.app account within 3 days. Giveaway Prizes will then be subsequently distributed to each Winner’s easyBitcoin.app account or wallet. If you are initially selected to receive a Giveaway Prize, you have three (3) days to respond and claim your Giveaway Prize. 

General Terms; Disclaimers

You acknowledge and agree that the Giveaway and any content, features or services provided in connection with it, are made available on an “as is” and “as available” basis, without warranties of any kind.

Nothing in this Giveaway is intended to, and shall not be construed as, providing any financial or investment advice. You further acknowledge that digital assets are highly volatile, and the act of predicting future prices involves inherent risk, which you voluntarily assume.

To the maximum extent permitted under applicable law, Uphold and EG expressly disclaim, and you agree to waive, any and all other warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, non-infringement, or warranties arising from a course of performance, course of dealing, or usage in trade.

Your participation in the Giveaway does not guarantee earnings or a specific reward amount. Giveaway Prizes are subject to change and may fluctuate based on market conditions beyond our control. In no event will we be liable to you for any decrease in the value of the Giveaway Prize or loss of earned Giveaway Prize due to market volatility, technical issues, or other unforeseen factors.

easyBitcoin.app is not responsible for any costs associated with claiming any Giveaway Prize. Use of the easyBitcoin.app, and claiming of any payment, may be subject to all relevant fees associated with the funding, transfer, exchange or removal of funds or value from accounts pursuant to easyBitcoin.app’s standard charges, available here. The Giveaway Program and use of the easyBitcoin.app are subject at all times to the easyBitcoin.app Terms and Conditions, available here. Violation of the Terms and Conditions will constitute a violation of these terms and conditions and result in the immediate disqualification of the Participant from the Giveaway Program. Giveaway Prizes are not exchangeable or transferable other than via the EasyBitcoin.app service.

Decisions of easyBitcoin.app are made in its sole discretion and final on all matters of fact, interpretation, eligibility, procedure and fulfillment in respect to the Giveaway Program. Each person is limited to one (1) EasyBitcoin.app account, regardless of the email account or contact information. Any attempt to create multiple memberships or accounts for the same user (either by closing and re-opening accounts or by using different contact information) or other deceptive or fraudulent activity is strictly forbidden and will result in immediate disqualification of the Participant from the Giveaway Program. EasyBitcoin.app reserves the right at any time in its sole discretion and without notice, subject to applicable law, to withdraw the Giveaway Program, modify the Giveaway Prize, and/or modify, amend, or supplement these rules. The above-mentioned changes do not affect any Giveaway Prize  that has been already paid out, if any, unless EasyBitcoin.app can prove that this was a result of client’s fraudulent activity or technical mistake.

Any personally identifiable information collected during an individual’s participation in the giveaway Program and registration process with easyBitcoin.app (if any) will be collected and used by easyBitcoin.app and their agents for the purposes of the proper administration and fulfillment of the Giveaway Program as described in these terms and conditions and for the operation of the easyBitcoin.app service and will be subject to easyBitcoin.app’s Privacy Notice available here.

easyBitcoin.app, its subsidiaries and affiliated companies, and each of their respective directors, officers, employees, agents, representatives, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind, whether caused by equipment, programming used in this Giveaway Program, human processing or otherwise, or any combination thereof; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of easyBitcoin.app that may cause the Giveaway Program to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of the rewards, or acceptance, possession, or use of the rewards, or from participation in the Giveaway Program; or (v) any printing or typographical errors in any materials associated with the Giveaway Program. easyBitcoin.app reserves the right, in its sole discretion, to suspend or cancel the Giveaway Program at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Giveaway Program. easyBitcoin.app also reserves the right to disqualify, in its sole discretion, any person tampering with the participation process, the operation of easyBitcoin.app’s site or app, or who is otherwise in violation of these terms and conditions. Any attempt to damage the easyBitcoin.app site or app or undermine the legitimate operation of the Giveaway Program is a violation of criminal and civil laws. Should such an attempt be made, easyBitcoin.app reserves the right to prosecute violators to the fullest extent allowable by law.

Each Participant is solely responsible for the reporting and payment of any and all taxes, if any, that may result from claiming or receiving the Giveaway Prize. By participating in this Giveaway Program, each participant acknowledges and agrees that they are solely responsible for determining and fulfilling any tax obligations that may arise from receiving any rewards, incentives, or other benefits. easyBitcoin.app does not provide tax advice and will not be responsible for any tax liabilities incurred by participants for receiving the Giveaway Prize. Participants are encouraged to consult with a tax advisor or qualified professional regarding their specific situation. Winners who are residents of the United States who win more than $600 USD in the Giveaway program  will be issued a 1099 tax form for reporting purposes.

Except where prohibited, participants agree that (1) any and all disputes, claims or causes of action arising out or connected with the Giveaway Program or any rewards awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration or alternate dispute resolution, as selected by Uphold before the American Arbitration Association (AAA), utilizing its Commercial Arbitration Rules, to take place in New York, New York; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred in participation but in no event attorney’s fees; and (3) under no circumstances will a participant be entitled to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions and the decisions of Uphold in connection with the Giveaway Program, shall be governed by and construed in accordance with the laws of California, without regard for conflict of laws doctrine.

Further, participation in this Giveaway Program is void where prohibited or restricted by law. Individuals residing in, or otherwise subject to the laws or regulations of, any jurisdiction deemed disqualified by easyBitcoin.app are not eligible to participate. easyBitcoin.app reserves the right to disqualify any participant who is found to be in violation of these restrictions, and any rewards or benefits issued in violation may be subject to forfeiture.

The Atomic Cash Sweep ("Cash Sweep") is a product offered by Atomic Brokerage that allows clients to earn interest on the available cash in their Atomic Brokerage account. Through Cash Sweep, clients' funds are deposited into an interest-bearing deposit account (“Deposit Account”) at one or more banks ("Program Banks"), where the funds earn a variable interest rate and are eligible for FDIC insurance coverage.

The annual percentage yield (APY) on the deposit balances in Cash Sweep is variable and subject to daily changes. Clients’ actual APY may be lower if they designate certain banks as ineligible to receive their deposits. The Program Bank list may change over time. For a current list of the Program Banks at any point in time, please refer to Atomic Brokerage’s website or contact Atomic Brokerage. Atomic Brokerage and third parties receive a fee for the Atomic Cash Sweep program.

If you participate in Cash Sweep, you authorize Atomic Brokerage to allocate your funds among one or more Program Banks at its discretion. Deposits at each Program Bank are insured by the FDIC up to $250,000 per insurable capacity. In total, funds deposited into Cash Sweep are eligible for up to $2,500,000 of FDIC insurance once the funds reach one or more Program Banks (up to $250,000 for each insurable capacity at up to 10 Program Banks). However, if clients exclude certain Program Banks, the amount of available FDIC insurance may be lower. Clients are responsible for monitoring the total amount of deposits that they have with each Program Bank, in order to determine the extent of FDIC deposit insurance coverage available to them. For more information on FDIC insurance, visit www.FDIC.gov.

Balances maintained in the Deposit Accounts at each Program Bank are FDIC insured but are not protected by SIPC. You should not expect cash deposited in an Atomic Brokerage account solely for the purpose of accessing the Cash Sweep to be protected by SIPC or FDIC insurance, and cash is only protected by FDIC insurance (subject to coverage limits and eligibility requirements) once deposited by Atomic in the unaffiliated bank deposit accounts. If you prefer your cash to be invested in a Money Market Fund eligible for SIPC coverage, you must send an email to [email protected] to discuss your options. You may obtain further information about SIPC coverage, including a brochure that describes SIPC and SIPC insurance, by accessing the SIPC website at www.sipc.org.
